The witness reportedly dismissed navigation lights because the colours seemed unusual and because night movement in the area was considered hazardous. That objection deserves consideration, but it is not decisive.
Marine lighting can appear strange under real-world conditions. Distance, haze, moisture, wave action and partial obstruction by islands can alter perceived colour and brightness. A light that is technically fixed can also appear to drift or hover when viewed across dark water with few visual reference points.
